Summary: In re Mathew B. Tully. Bar No. 491695. July 30, 2025. The Board on Professional Responsibility recommended that the D.C. Court of Appeals suspend Tully for 90 days. Tully’s misconduct arose principally from his conduct relating to lawyer and nonlawyer employees of his law firm’s office in the District of Columbia. Specifically, Tully violated Rules 8.4(a) and 5.6, in that he attempted to participate in, or did participate in, offering and making employment and similar type agreements that restricted the rights of lawyers to practice after termination of their relationship with the firm; Rules 5.1(b) and 5.3(b), in that, having direct supervisory authority over other lawyers and nonlawyer assistants, he failed to make reasonable efforts to ensure that those persons conformed to the Rules of Professional Conduct; Rules 5.1(c)(1) and (2), in that he ordered or, with specific knowledge of the conduct, ratified conduct that violated the Rules (Tully knew or reasonably should have known of conduct by subordinate lawyers at a time when its consequences could be avoided or mitigated but failed to take reasonable remedial action); and Rules 8.4(a) and (d), in that he attempted to engage in, or engaged in, conduct that seriously interfered with the administration of justice by deterring witnesses from cooperating with Disciplinary Counsel.
