Summary: In re Charles C. Agwumezie. Bar No. 990751. February 3, 2022. The D.C. Court of Appeals accepted Agwumezie’s petition for negotiated discipline and suspended him for three years with fitness. Agwumezie recklessly misappropriated entrusted client funds and violated Rules 1.5(b) (written statement of fees, scope of representation, and expenses); 1.7(b)(4) (conflict of interest); 1.15(a) (commingling, reckless misappropriation, and record-keeping); 8.1(b) (knowingly failing to respond reasonably to Disciplinary Counsel’s lawful demands for information); and 8.4(d) (serious interference with the administration of justice).

Summary: In re Charles C. Agwumezie. Bar No. 990751. July 19, 2021. Referred by the D.C. Court of Appeals to address the question of the appropriateness of the recommended sanction in light of the court's precedent in cases involving reckless misappropriation, the Board on Professional Responsibility recommended that the court approve the sanction of a three-year suspension plus a requirement that Agwumezie prove his fitness to practice for violations of Rules 1.5(b), 1.7(b)(4), 1.15(a), 8.1 (b), and 8.4(d). Following its report in In re Mensah, the Board held that the sanction was not unduly lenient negotiated discipline despite the presence of reckless misappropriation. Three Board members, who had concurred in Mensah, dissented, finding that the sanction was unduly lenient when applied to Agwumezie's conduct.
