Have Employees in New York? New Sexual Harassment Requirements Are Now in Effect
All nonprofits that employ individuals in New York State and New York City--including those based in DC or other jurisdictions--must now comply with recently enacted sexual harassment training, notice, and governance requirements.
Under New York State law, all employers (regardless of size) with New York-based employees must adopt a sexual harassment policy (including complaint forms) and provide New York-based employees with annual, interactive sexual harassment training. The state has developed online training webinars and template policies that can help employees satisfy these requirements.
New York City-specific requirements also apply for employers with over 15 employees, any of whom work in New York City. The NYC law contains its own training requirements, along with the requirement to provide employees with anti-sexual harassment fact sheets and workplace posters. The city has developed its own online training webinar which can satisfy both State and City training requirements.
