Superior Court Issues Order Regarding Evaluation of Juvenile Restorative Justice Program

On March 4, the Superior Court of the District of Columbia issued Administrative Order 21-01 authorizing the Office of the Attorney General of the District of Columbia (OAG) to share only de-identified case records and law enforcement records of juveniles in the delinquency system for the purposes of evaluating its restorative justice prosecution program.

The order permits access to the records by Professor Miguel de Figueiredo of the University of Connecticut School of Law and Associate Professor Dane Thorley of Brigham Young University Law, who have been tapped by OAG to study the impact and efficacy of its restorative justice prosecution program.

The order further permits OAG to publish aggregate-level, de-identified data and allows such data to be shared with the institutional review boards from the professors’ respective universities.

Court of Appeals Specifies When a Flat Fee Is Earned

In re Alexei, decided August 1, 2024, by the D.C. Court of Appeals, holds that absent an agreement specifying to the contrary, an attorney earns a flat-fee payment only upon completion of all enlisted services. The court announced its interpretation of Rule 1.15 of the D.C. Rules of Professional Conduct for the first time, clarifying an issue previously addressed in In re Mance.
