DCCA Opinion (June 13, 2024)

Summary: In re John P. Mahoney. Bar No. 442839. June 13, 2024. The D.C. Court of Appeals accepted the Office of Disciplinary Counsel’s and Mahoney’s joint petition for negotiated discipline and suspended Mahoney for 60 days, with 30 days stayed in favor of one year of probation with conditions for violations of Rules 1.4(a), 1.16(d), 5.1(b), and 5.1(c)(2). Mahoney voluntarily acknowledged that in six client matters he failed to take reasonable steps to ensure that two subordinate attorneys complied with their ethical duties to clients and did not take reasonable remedial action to avoid or mitigate the consequences of the subordinates’ conduct, of which he knew or reasonably should have known. In four of the six matters, Mahoney personally failed to respond to reasonable requests for information from the clients (and one of those matters involved a proceeding pending before a federal tribunal sitting in Maryland). And in three of the six matters, Mahoney personally failed to protect the clients’ interests as the representation was ending.
