Summary: The D.C. Court of Appeals accepted Vorv’s petition for negotiated discipline and suspended him for 30 days, stayed in favor of one year of probation with conditions. While retained to represent a client in immigration proceedings, Vorv failed to provide competent representation, failed to explain a matter to the client, and engaged in conduct that seriously interfered with the administration of justice. Specifically, Vorv improperly conceded before the immigration court that his client’s prior criminal conviction for burglary constituted an “aggravated felony” within the meaning of the Immigration and Nationality Act (INA), and that his client was, therefore, removable. Ultimately, the client retained new counsel who successfully argued that the client’s conviction was not for an “aggravated felony” within the meaning of the INA, and that the client was, therefore, not removable from the United States. Rules 1.1(a), 1.1(b), 1.4(b), and 8.4 (d).
