DCCA Opinion (December 6, 2018)

Summary: The D.C. Court of Appeals disbarred Smith. Smith was convicted in the state of Delaware of one count of Continuous Abuse of a Child and one count of Sex Abuse of a Child by a Person in a Position of Trust, crimes involving moral turpitude per se, for which disbarment is mandatory under D.C. Code § 11-2503(a)(2001), and three counts of Unlawful Sexual Contact in the First Degree.

Summary: February 1, 2018. This matter was before the Board on Professional Responsibility pursuant to an order of the D.C. Court of Appeals directing the Board to institute a formal proceeding to determine the nature of the final discipline to be imposed, based on Smith’s felony convictions in Delaware of continuous sexual abuse of a child, sexual abuse of a child by a person in a position of trust, and unlawful sexual contact first degree. The Board found that Smith’s conviction under 11 Del. C. 778A(1) involved moral turpitude per se and recommends disbarment pursuant to D.C. Code § 11-2503(a).

Summary: Smith was suspended on an interim basis based upon his conviction of a serious crime in the Superior Court of the State of Delaware.
