DCCA Order (January 15, 2019)

Summary: The District of Columbia Court of Appeals denied Disciplinary Counsel's motion to remand and sua sponte ordered that Respondent must demonstrate fitness prior to being reinstated.

DCCA Opinion (November 29, 2018)

Summary: A panel of the D.C. Court of Appeals vacated its earlier opinion issued on March 8, 2018, and suspended Nave for one-year, with fitness. See January 15, 2019 Order. The Court rejected the Board’s recommendation to disbar Nave because it concluded that the finding that she misappropriated funds was not supported by clear and convincing evidence. The Court accepted the Board’s conclusion that Nave violated Rule 1.15 (a) by failing to place the funds of a third party in trust, violated Rule 1.15 (c) by failing to deliver promptly funds that a third party was entitled to receive, and violated Rule 1.15 (d) by failing to timely distribute funds. One Judge dissented and would have disbarred Nave for misappropriation.

DCCA Order (October 4, 2016)

Summary: Nave was suspended on an interim basis pursuant to D.C. Bar R. XI, § 9(g), pending final action on the Board on Professional Responsibility’s June 23, 2016, recommendation of disbarment.

Board Report and Orders (June 23, 2016)

Summary: The Board on Professional Responsibility recommends the D.C. Court of Appeals disbar Nave. While representing multiple personal injury claimants, Nave failed to safe-guard funds sufficient to pay medical providers who had a claim against those funds, failed to promptly deliver funds, failed to distribute funds, and engaged in intentional misappropriation. Rules 1.15(a), 1.15(c), and 1.15(d).
