Court of Appeals accepted Flower’s petition for negotiated discipline and publicly censured her for violations of Rules 1.1(a) (competence) and 1.16(d) (failure to protect client’s interests in connection with termination of representation), or the parallel violations under 8 C.F.R. § 1003.102 (Executive Office for Immigration Review grounds for discipline). Flower voluntarily acknowledged that, during the pendency of an immigration appeal, she failed to both provide competent representation and protect the client’s interests in connection with terminating the representation by withdrawing the appeal without the client’s consent rather than simply moving to withdraw as counsel.
