Summary: In re James A. Moody. Bar No. 294504. February 1, 2024. The Board on Professional Responsibility recommended that the D.C. Court of Appeals disbar Moody and that client restitution would be highly relevant evidence should he seek reinstatement. While retained to represent a California raisin producer who sought to recover economic losses it suffered due to the set-aside program, Moody violated Rules 1.5(b) (failure to provide a written statement regarding fees and scope of representation), 1.15(a) and 1.15(d) (intentional misappropriation), 1.15(c) (failure to notify client of the receipt of settlement funds), 8.1(b) (knowing failure to respond to Disciplinary Counsel’s requests for information), 8.4(c) (conduct involving dishonesty, fraud, and deceit), and 8.4(d) (serious interference with the administration of justice), as well as D.C. Bar Rule XI, § 2(b)(3) (duty to comply with court and Board orders).
